Data Protection  [7/12/2007 13:37:32]

We are currently migrating our UK Call Centre to Manila.

To help coach them in UK Accents we are supplying the training team in Manila with call samples recorded in the UK.

We have the usual disclaimer on our IVR 'your call may be used for training purposes' etc however, is there any legal implications we need to consider when sending these calls off-shore?

Thanks

Kevin

Data Protection Act  [7/12/2007 15:17:56]

It would depend on the content of the calls, assuming that personal information is contained within them, the DPA will apply.

The Data Protection Act controls the use of data transferred outside of the EEA. Basically it states that personal data must not be transferred to a country outside the EEA unless that country ensures an adequate level of protection.

I am unsure what legislation is currently in place in the Philippines to support the above though.
